Is there a Cap on damage awards for injuries?

In Nova Scotia, there is a Cap on damages that can be received for minor injuries suffered in automobile accidents. The limit for these injuries is $7,500 and what qualifies as a minor injury is amazingly broad.

The good news is is that this Cap is currently under challenge by the Atlantic Provinces Trial Lawyers Association on constitutional grounds. If the Cap is struck down as unconstitutional, we expect that all claims will be settled on the basis of the system prior to the Cap and be compensated fairly.
